Guatemalan Illegal Alien, Who Is Also a Convicted Sex Offender, Arrested in Massachusetts

An illegal immigrant who fled California, where he had been jailed as a sex offender, has been arrested in Massachusetts.

The Boston office of Enforcement and Removal Operations, a division of Immigration and Customs Enforcement, said the man was first arrested last week by police in Waltham, Massachusetts, after learning he was wanted by California authorities, according to an ICE news release.

The man, whose name was withheld, is a 35-year-old Guatemala native, the release said.

The Guatemalan man had been sentenced to three years in prison in California on charges of sex with a minor victim and sexual penetration with a foreign object on a minor. He served one year in prison and was released, only to disappear and fail to register as a sex offender.

The suspect was arrested by Waltham police, released by Waltham District Court, and then arrested for immigration violations because he had long overstayed the visa he received in 2011, during the administration of former President Barack Obama, that allowed him into the country.

The release said he will remain in the custody of immigration authorities until he is deported.

“Convicted sex offenders have no right to hide out in our communities and they pose a threat to public safety,” ERO Boston Field Office Director Todd Lyons said.

Last year, ERO participated in a nationwide sweep of illegal immigrants who were sex offenders and arrested 138 people, according to an ICE release.

The nation has known for years that many illegal immigrants have criminal records.

“Of the 123,128 ERO administrative arrests in FY 2019 with criminal convictions or pending criminal charges, the criminal history for this group represented 489,063 total criminal convictions and pending charges as of the date of arrest, which equates to an average of four criminal arrests/convictions per alien, highlighting the recidivist nature of the aliens that ICE arrests,” ICE reported in its 2019 annual report.

ICE reported in its news release that in the 2022 fiscal year, ERO arrested 46,396 illegal immigrants with criminal histories.

Of those, there were 198,498 associated charges and convictions, including 21,531 assault offenses; 8,164 sex and sexual assault offenses; 5,554 weapons offenses; 1,501 homicide-related offenses; and 1,114 kidnapping offenses, ICE said in its release.

The revolving-door nature of illegal immigrant criminals was revealed this summer when Elvis Cristian Hernandez-Ayala was arrested, according to Judicial Watch.

After his arrest, authorities learned he had been deported eight times after convictions on crimes that included sexual assault and drug possession.

Judicial Watch noted that the case “illustrates the gravity of the security lapses along the southwest border.”
